NemKonto in a Foreign Financial Institution

Companies may designate a NemKonto to an account issued by one of the following types of account-holding institutions:

1. Danish banks

2. Danish payment institutions

3. Danish e-money institutions

4. EU/EEA credit institutions

5. EU/EEA payment institutions

6. EU/EEA e-money institutions

7. Faroese and Greenlandic banks

8. Faroese payment and e-money institutions

9. Credit institutions outside of the EU/EEA

According to the NemKonto Act, a NemKonto can only be designated with financial institutions that are subject to financial regulation.

You should therefore be aware that some financial institutions may not have the necessary licenses. This may mean that they are not obligated to comply with the security and supervision requirements that other financial institutions are subject to.

If you are in doubt as to whether the financial institution you wish to use is under financial regulation, you can search for it in the Danish Financial Supervisory Authority’s company register.

Please note that the register does not contain a complete list of financial institutions that can be used for NemKonto purposes.

Companies should also be aware that most financial institutions require the company to open a business account before a NemKonto can be designated.

If you wish to designate a foreign account as your company’s NemKonto, you must complete an application and submit it to the Danish Agency for Digital Government (Digitaliseringsstyrelsen).

There are two ways to apply:

1. With MitID Erhverv
2. Without MitID Erhverv

Please note that you cannot designate a foreign account as the company's NemKonto directly through foreign financial institutions, but only by following the application process below.

• Follow the link.
• Log in with MitID Erhverv.
  • It is also possible to log in using MitID Private for Business.
• The application must comply with the company’s signing rules, but can be completed by someone other than the authorized signatories.
  • Except for sole proprietorships, where the owner must complete the application themselves.
• After submission, a link for digital signature will be sent to the authorized signatories.

If the company does not use MitID Erhverv:

1. Complete and sign the physical form (PDF) in the presence of a notary, a lawyer, or two witnesses.
2. Attach the following documentation:
   • A copy of valid ID for the authorized signatories.
   • Documentation of the company's signing authority in Danish or English, such as the articles of association (not required for Sole Proprietorship).
   • An extract from the government business register in the company's home country.
     • Only applicable to foreign companies.
     • The extract must confirm that the signer has the authority to sign on behalf of the company.
     • The extract must be no older than one month.
   • Registration certificate from the Danish Tax Agency
     • Only applicable for SE numbers.

Send the NemKonto form and documentation to the Danish Agency for Digital Government (Digitaliseringsstyrelsen).

If your company is applying for a NemKonto in a foreign financial institution (e.g. a bank) without MitID Erhverv, the application form and supporting documents can be submitted in one of the following ways:

The Danish Agency for Digital Government will receive your application for a NemKonto and process it within 8-10 weeks.

To avoid delays, it is advisable for the company to double-check that all required documentation is included.

If the submitted documentation is adequate and a NemKonto can be assigned for the company, you will receive an activation letter.

The activation letter will be sent via physical mail to the company’s registered address in the Central Business Register (CVR). It can therefore be a good idea to make sure that the company's name is written clearly on the mailbox, so the letter can be delivered correctly.

Please note that we cannot send the activation letter via email, Digital Post, or to an alternative address.

If you are reporting a NemKonto on behalf of someone else or for a company where you are not an authorized signatory, this is considered a third-party submission.

For third-party submissions, in addition to the application form and documentation listed above, you must include a power of attorney from the company’s authorized signatory. This document must authorize you to designate a NemKonto on behalf of the company. The power of attorney must be translated into Danish or English. This requirement applies to accountants, but not to legal representation by lawyers.

The power of attorney must include the following information:

• Account details (registration and account number or IBAN and SWIFT).
• Notarial certification or signatures from two witnesses confirming the identities of both parties.
• A copy of valid identification for both parties.

Companies that have registered units with SE or P numbers can assign a NemKonto for each of these units. However, it is up to the public authority in charge of the payment to determine whether transfers can be made using an SE or P number as the payment identification.
